Quarryplan has developed a number of approaches for challenging enforcement proceedings on mineral development. While it is best to act early, it may never be too late to involve Quarryplan.

A system of planning enforcement exists to deal with cases in which development is thought to have been carried out either without planning permission or in breach of the conditions or limitations attached to the grant of planning permission.

Enforcement Action

The main planning enforcement powers include:

  • Enforcement Notice - requiring steps to remedy the breach within a specific time period;
  • Stop Notice - which can prohibit, almost immediately, any activity to which the accompanying enforcement notice relates;
  • Temporary Stop Notices;
  • Submission or Notice Requiring a Planning Application;
  • Enforcement of Conditions (Breach of Condition Notice);
  • Planning Contravention Notices; and
  • Injunctions

Quarryplan considers it is fundamental that you act as soon as possible to any enforcement threats, warning letters and/or Notices - timing is key to any successful resolution.
